By accessing or using xMerch, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Marketplace Role

xMerch provides marketplace technology and payment/settlement coordination. Vendors are responsible for product descriptions, pricing, fulfillment, and customer support for their items. xMerch is not a bank, money transmitter, or financial institution.

3. Eligibility

You must be at least 18 years old and able to form a binding contract. You may not use xMerch if you are subject to sanctions, restricted by applicable law, or if access is prohibited in your jurisdiction.

4. Accounts, Wallets, and Security

You are responsible for maintaining the security of your wallet, private keys, devices, and any account credentials. We do not custody assets or recover lost keys.

5. Purchases, Payments, and On/Off-Ramp

• Product prices, availability, and policies are set by vendors.
• If you use a third-party on/off-ramp (for example, MoonPay), you are entering into a separate agreement with that provider and may be required to complete identity verification.
• We may share necessary order information with payment and compliance providers to fulfill transactions and meet legal obligations.
• We may block, delay, or cancel orders or transactions to comply with law, prevent fraud, or respond to network issues.

6. Blockchain Transactions

Blockchain transactions are generally irreversible. You are responsible for confirming wallet addresses and network details before sending. Network fees may apply and are not controlled by xMerch.

7. Fees and Taxes

You are responsible for any taxes, duties, or fees applicable to your purchases. Vendors may include taxes in pricing or collect them at checkout where required.

8. Shipping, Returns, and Disputes

Shipping timelines, return policies, and dispute procedures are set by vendors unless otherwise stated. Contact the vendor or xMerch support to resolve order issues.

9. Prohibited Conduct

• Violating applicable laws or regulations.
• Attempting to circumvent security, payments, or compliance checks.
• Using the service for fraud, money laundering, or prohibited items.
• Interfering with the marketplace or other users' access.

10. Intellectual Property

xMerch and its logos, design, and software are owned by us or our licensors. You may not use our branding or content without permission.

11. Third-Party Services

We may link to or integrate services operated by third parties, including blockchain networks and payment providers. We are not responsible for third-party services and their policies.

12. Disclaimers

The service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, xMerch will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the service.

14. Indemnification

You agree to indemnify and hold xMerch harmless from claims arising out of your misuse of the service, violation of these Terms, or infringement of any rights of another.

15. Termination

We may suspend or terminate access to the service if you violate these Terms or for compliance reasons. You may stop using the service at any time.

16. Governing Law

These Terms are governed by the laws of the jurisdiction where xMerch is organized, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date.
